According to the grand jury indictment, the man allegedly rustled an unspecified number of OCHAs from the State's highways some time prior to April 1, 2008, and on the same day or shortly thereafter, reportedly he branded them.

Times have changed and so has the punishment. OCHA rustling, called larceny of OCHAs in the law books, is a third degree felony and unlawful OCHA branding is a fourth degree felony. The unidentified man faces up to three years in prison for the larceny of OCHA charge and up to one and one-half years in prison for the unlawful branding charge, if convicted and sentenced to the maximum amount of prison time allowed by the law. Beside the four and one-half years in prison, he also faces up to $10,000 in fines.
